La normativa pasar\u00e1 ahora a manos del presidente <a href=\"https:\/\/acl.com.ec\/en\/daniel-noboa-detalla-tres-puntos-clave-de-la-reforma\/\">Daniel Noboa<\/a>.<\/strong><\/h5><p><span style=\"font-weight: 400;\">La Asamblea Nacional aprob\u00f3 por unanimidad un paquete de reformas al C\u00f3digo de Trabajo y a la Ley Org\u00e1nica de Servicio P\u00fablico para prevenir, evitar y sancionar la violencia y el acoso laboral.<\/span><\/p><p><span style=\"font-weight: 400;\">La nueva normativa es aplicable tanto para el sector p\u00fablico como privado y est\u00e1 pensada, seg\u00fan los proponentes, para generar un ambiente laboral saludable, en el que los empleadores tengan la obligaci\u00f3n de prevenir y abordar estas conductas en el espacio de trabajo.<\/span><\/p><p><span style=\"font-weight: 400;\">La reforma trae algunas novedades que no eran parte de anteriores normativas que buscaban frenar los abusos en el \u00e1mbito laboral. Ahora, se incluyen sanciones para el acoso por otras v\u00edas como las tecnol\u00f3gicas.<\/span><\/p><h5>Claves de la reforma<\/h5><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Los casos de violencia y acoso podr\u00e1n ser denunciados as\u00ed ocurran una sola vez o de forma repetitiva.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La violencia y el acoso laboral comprende tambi\u00e9n la no desconexi\u00f3n digital, es decir, cuando el empleador llama o escribe al empleado en horarios no laborables.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tambi\u00e9n se toma en cuenta como infracci\u00f3n el desacato al tiempo de descanso, permisos y vacaciones, as\u00ed como de la privacidad de la intimidad personal y familiar.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se sancionar\u00e1 el cambio de ocupaci\u00f3n, sin autorizaci\u00f3n expresa y escrita del trabajador, constituye violencia psicol\u00f3gica y patrimonial en el caso de reducci\u00f3n de la remuneraci\u00f3n.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Est\u00e1n protegidos por esta ley, personas en formaci\u00f3n, pasantes, aprendices, despedidos, voluntarios, personas en busca de empleo, postulantes a un empleo y tercerizados.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">En los casos comprobados, el inspector de trabajo emitir\u00e1 sanciones pecuniarias en contra de la persona, natural o jur\u00eddica que haga las veces de empleador.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dispondr\u00e1 medidas de reparaci\u00f3n y de apoyo con la ayuda de \u00f3rganos especializados del sector p\u00fablico y privado.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">En los casos en que no se llegue a determinar a los responsables de violencia o acoso a trav\u00e9s de redes sociales o medios digitales, se dejar\u00e1 constancia, como medida reparatoria, que se trata de un presunto caso de acoso en contra de un trabajador.<\/span><\/li><\/ul><p>La asamble\u00edsta proponente, Mar\u00eda Pasquel, dijo que la normativa no busca socapar la mediocridad, que se puede dar en algunos casos, sino proteger a los trabajadores que cumplen con sus labores a cabalidad y, pese a aquello, son v\u00edctimas de injusticias.<\/p><p>Aclar\u00f3, que la ley no solo busca sancionar la violencia que se produce desde los empleadores hacia los empleados, sino de trabajadores hacia otros compa\u00f1eros de trabajo. El documento aprobado por 128 asamble\u00edstas presentes en la sesi\u00f3n ser\u00e1 enviado al Ejecutivo para que el presidente Daniel Noboa vete o ratifique el texto, previo a su puesta en
