data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: center;\"><b>ACUERDO MINISTERIAL N\u00b0 MDT-2022-236<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Mediante Acuerdo Ministerial N\u00b0 MDT-2022-236 emitido por el Ministerio del Trabajo el 21 de diciembre del 2022, publicado en el Registro Oficial Suplemento 232 de fecha 18 de enero de 2023, se establecieron las directrices para las mediaciones que se lleven a cabo en el Centro de Mediaci\u00f3n del <a href=\"https:\/\/acl.com.ec\/en\/mrl-fija-sbu-del-trabajador-en-general-en-450-para-2023\/\">Ministerio de Trabajo<\/a>, con el objetivo de promover la resoluci\u00f3n de conflictos entre empleadores y trabajadores.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El servicio que prestar\u00e1 el Centro de Mediaci\u00f3n del Ministerio del Trabajo ser\u00e1 gratuito y podr\u00e1 ser solicitado tanto por los empleadores como trabajadores del sector p\u00fablico o privado.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El presente Acuerdo Ministerial, determina que la transacci\u00f3n en materia laboral es v\u00e1lida, siempre que no implique renuncia de derechos; en este sentido, los mediadores y partes deber\u00e1n observar los siguientes criterios:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Negociaci\u00f3n Real: El mediador deber\u00e1 invitar a las partes a realizar concesiones mutuas, con el fin de lograr un acuerdo equitativo entre las partes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Negociaci\u00f3n sobre derechos inciertos y discutibles: Tiene como base el principio constitucional de irrenunciabilidad de derechos, por lo que, solo las pretensiones inciertas, discutibles, sujetas a valoraci\u00f3n o a determinaci\u00f3n judicial podr\u00e1n ser negociadas en mediaci\u00f3n.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">El efecto de la mediaci\u00f3n, siempre que las partes lleguen a un acuerdo ser\u00e1 la suscripci\u00f3n del Acta de Mediaci\u00f3n, misma que surtir\u00e1 efectos definitivos y tendr\u00e1 valor de sentencia ejecutoriada con efecto de cosa juzgada.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En el caso de las mediaciones contempladas en los literales b) y c) del art\u00edculo 555 del C\u00f3digo del Trabajo, que se refieren a conflictos colectivos, la competencia para conocerlas la tendr\u00e1 exclusivamente la Direcci\u00f3n de Mediaci\u00f3n Laboral.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Las disposiciones del presente acuerdo ministerial entraron en vigencia el 21
