data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Seg\u00fan el C\u00f3digo de Trabajo en su Art. 94 establece lo siguiente:<\/span><\/p><p><span style=\"font-weight: 400;\">El empleador que no hubiere cubierto las remuneraciones que correspondan al<a href=\"https:\/\/acl.com.ec\/en\/derecho-del-empleador-para-descontar-aportes-al-trabajador\/\"> trabajador<\/a> durante la vigencia de las relaciones de trabajo, y cuando por este motivo, para su entrega, hubiere sido menester la acci\u00f3n judicial pertinente ser\u00e1, adem\u00e1s, condenado al pago del triple del equivalente al monto total de las remuneraciones no pagadas del \u00faltimo trimestre adeudado, en beneficio del trabajador.<\/span><\/p><p><span style=\"font-weight: 400;\">De determinarse por cualquier medio, que un empleador no est\u00e1 pagando las remuneraciones m\u00ednimas vigentes en los t\u00e9rminos legales establecidos, el Ministro de Trabajo y Empleo, conceder\u00e1 un t\u00e9rmino de hasta cinco d\u00edas para que durante este lapso el empleador desvirt\u00fae, pague o suscriba un convenio de pago de las diferencias determinadas.<\/span><\/p><p><span style=\"font-weight: 400;\">Si dentro del t\u00e9rmino concedido no desvirt\u00faa, paga o suscribe el convenio de pago, seg\u00fan el caso, el empleador moroso ser\u00e1 sancionado con el ciento por ciento de recargo de la obligaci\u00f3n determinada, pago que deber\u00e1 cumplirse mediante dep\u00f3sito ante la inspector\u00eda del trabajo de la correspondiente jurisdicci\u00f3n, dentro del t\u00e9rmino de tres d\u00edas posteriores a la fecha del mandamiento de
