{"id":28893,"date":"2021-08-27T16:11:55","date_gmt":"2021-08-27T21:11:55","guid":{"rendered":"https:\/\/acl.com.ec\/?p=28893"},"modified":"2021-08-27T16:11:55","modified_gmt":"2021-08-27T21:11:55","slug":"seguro-colectivo-de-cesantia","status":"publish","type":"post","link":"https:\/\/acl.com.ec\/en\/seguro-colectivo-de-cesantia\/","title":{"rendered":"Seguro colectivo de cesant\u00eda"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text]<\/p>\n<div class=\"title-h1\" style=\"text-align: center;\"><span style=\"color: #7e9fbb;\"><b>SEGURO COLECTIVO DE CESANT\u00cdA<\/b><\/span><\/div>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>Art. 274.- CESANT\u00cdA.- <\/b><span style=\"font-weight: 400; color: #000000;\">Para los efectos de esta Ley, se entender\u00e1 como cesant\u00eda la falta de ingresos provenientes del trabajo de un empleado u obrero o servidor p\u00fablico, afiliado al IESS, siempre que: <\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #88a0ba;\"><strong>a)<\/strong><\/span> El afiliado no haya abandonado voluntariamente su trabajo; no se entender\u00e1 abandono voluntario la firma de un Acta de Finiquito.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\"><span style=\"color: #88a0ba;\"><strong>b)<\/strong><\/span> La terminaci\u00f3n de la relaci\u00f3n laboral haya sido resuelta unilateralmente por el empleador.<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\"><span style=\"color: #88a0ba;\"><strong>c)<\/strong> <\/span>La permanencia en el trabajo supere los doce (12) meses.<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\"><span style=\"color: #88a0ba;\"><strong>d)<\/strong><\/span> El afiliado cesante no tenga acceso a recibir otras prestaciones del IESS.<\/span><\/span><\/p>\n<p><b>Art. 170.- LINEAMIENTOS DE POLITICA.-<\/b><span style=\"font-weight: 400; color: #000000;\"> El Seguro General Obligatorio proteger\u00e1 al afiliado en relaci\u00f3n de dependencia contra la contingencia de cesant\u00eda:\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\"><span style=\"color: #88a0ba;\"><strong>a)<\/strong><\/span> A los actuales trabajadores afiliados menores de cuarenta (40) a\u00f1os, los comprendidos entre cuarenta (40) y cuarenta y nueve (49) a\u00f1os que ejerciten la opci\u00f3n por el sistema mixto de pensiones y, los que ingresaren como afiliados al IESS a partir de la vigencia de esta Ley, mediante la contrataci\u00f3n de una p\u00f3liza de seguro colectivo, debidamente reasegurada, que se financiar\u00e1 con una fracci\u00f3n de los rendimientos de la inversi\u00f3n del fondo de reserva del trabajador, en los t\u00e9rminos que se\u00f1ala esta Ley.<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\"><span style=\"color: #88a0ba;\"><strong>b)<\/strong><\/span> A los trabajadores afiliados mayores de cuarenta (40) a\u00f1os que no ejerciten la opci\u00f3n por el sistema mixto de pensiones, y los mayores de cincuenta (50) a\u00f1os amparados por el r\u00e9gimen de transici\u00f3n, tendr\u00e1n derecho a la prestaci\u00f3n de cesant\u00eda en la forma que se\u00f1alan los art\u00edculos 283 y 284 de esta Ley. En cuanto a los derechohabientes de este grupo de asegurados, se estar\u00e1 a lo dispuesto en el art\u00edculo 285 de esta misma Ley.<\/span><\/span><\/p>\n<p><b>Art. 277.- PRESTACION DE CESANTIA.-<\/b><span style=\"font-weight: 400; color: #000000;\"> La prestaci\u00f3n de cesant\u00eda consistir\u00e1 en la entrega de una suma de dinero equivalente a tres (3) veces la remuneraci\u00f3n imponible mensual promedio actualizada de los \u00faltimos doce (12) meses de aportaci\u00f3n previas al cese.
