color: #000000;\">Seg\u00fan el art\u00edculo 188 del C\u00f3digo de Trabajo menciona que el empleador que despidiere intempestivamente al trabajador, ser\u00e1 condenado a indemnizarlo, de conformidad con el tiempo de servicio y seg\u00fan la siguiente escala:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Hasta 3 a\u00f1os de servicio, con el valor correspondiente a 3 meses de remuneraci\u00f3n.<\/span><\/span><\/li>\n<li><span style=\"color: #000000;\">De m\u00e1s de 3 a\u00f1os, con el valor equivalente a un mes de remuneraci\u00f3n por cada a\u00f1o de servicio, sin que en ning\u00fan caso ese valor exceda de 25 meses de remuneraci\u00f3n.<\/span><\/li>\n<\/ul>\n<p><b>La fracci\u00f3n de un a\u00f1o se considerar\u00e1 como a\u00f1o completo.<\/b><\/p>\n<p><span style=\"font-weight: 400; color: #000000;\">El c\u00e1lculo de estas indemnizaciones se har\u00e1 en base de la remuneraci\u00f3n que hubiere estado percibiendo el trabajador al momento del despido.<\/span><\/p>\n<p><span style=\"font-weight: 400; color: #000000;\">Si el trabajo fuere a destajo, se fijar\u00e1 la remuneraci\u00f3n mensual a base del promedio percibido por el trabajador en el a\u00f1o anterior al despido, o durante el tiempo que haya servido si no llegare a un a\u00f1o.<\/span><\/p>\n<p><span style=\"font-weight: 400; color: #000000;\">En el caso del trabajador que hubiere cumplido 20 a\u00f1os, y menos de 25 a\u00f1os de trabajo, continuada o ininterrumpidamente, adicionalmente tendr\u00e1 derecho a la parte proporcional de la jubilaci\u00f3n patronal.<\/span><\/p>\n<p><span style=\"font-weight: 400; color: #000000;\">Las indemnizaciones por despido, previstas en este art\u00edculo, podr\u00e1n ser mejoradas por mutuo acuerdo entre las partes, mas no por los Tribunales de Conciliaci\u00f3n y Arbitraje.<\/span><\/p>\n<p><span style=\"font-weight: 400;
