Y EL SEGURO DE DESEMPLEO"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text]<\/p>\n<h1 style=\"text-align: center;\"><span style=\"color: #7e9fbb;\">CESANT\u00cdA Y EL SEGURO DE DESEMPLEO <\/span><\/h1>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<span style=\"font-weight: 400; color: #000000;\">Seg\u00fan la Ley de Seguridad Social en su T\u00edtulo IX, Cap\u00edtulo uno, art\u00edculo 274 establece lo siguiente:<\/span><\/p>\n<p><b>Art. 274.- CESANT\u00cdA.- <\/b><span style=\"font-weight: 400; color: #000000;\">Se entender\u00e1 como cesant\u00eda la falta de ingresos provenientes del trabajo de un empleado u obrero o servidor p\u00fablico, afiliado al IESS, siempre que:<\/span><\/p>\n<p><span style=\"font-weight: 400; color: #000000;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">a)<\/span> <span style=\"font-weight: 400;\">El afiliado no haya abandonado voluntariamente su trabajo; no se entender\u00e1 abandono voluntario la firma de un Acta de Finiquito;<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">b)<\/span> <span style=\"font-weight: 400;\">La terminaci\u00f3n de la relaci\u00f3n laboral haya sido resuelta unilateralmente por el empleador;<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">c)<\/span> <span style=\"font-weight: 400;\">La permanencia en el trabajo supere los doce (12) meses; y,<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">d)<\/span> <span style=\"font-weight: 400;\">El afiliado cesante no tenga acceso a recibir otras prestaciones del IESS.<\/span><\/span><\/p>\n<p>[\/vc_column_text][vc_column_text]<b>Art. &#8230;.- Seguro de Desempleo.- <\/b><span style=\"font-weight: 400; color: #000000;\">Es la prestaci\u00f3n econ\u00f3mica que protege a los afiliados del IESS, bajo relaci\u00f3n de dependencia por la p\u00e9rdida de ingresos generada por un cese temporal de actividades productivas por causas ajenas a su voluntad.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>Art. &#8230; .- Requisitos.- <\/b><span style=\"font-weight: 400; color: #000000;\">La persona afiliada para acceder a la prestaci\u00f3n de Seguro de Desempleo deber\u00e1 cumplir los siguientes requisitos en cada evento de desempleo:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">a)<\/span> <span style=\"font-weight: 400;\">Acreditar 24 aportaciones acumuladas y no simult\u00e1neas en relaci\u00f3n de dependencia, de las cuales al menos 6 deber\u00e1n ser continuas e inmediatamente anteriores a la contingencia;<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">b)<\/span> <span style=\"font-weight: 400;\">Encontrarse en situaci\u00f3n de desempleo por un per\u00edodo no menor a 60 d\u00edas;<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">c)<\/span> <span style=\"font-weight: 400;\">Realizar la solicitud para el pago de la prestaci\u00f3n a partir del d\u00eda 61 de encontrarse desempleado, y hasta en un plazo m\u00e1ximo de 45 d\u00edas posteriores al plazo establecido.<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">d)<\/span> <span style=\"font-weight: 400;\">No ser jubilado.<\/span><\/span><\/p>\n<p><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400; color: #000000;\">En caso de suscitarse el evento de desempleo, el afiliado podr\u00e1 optar por una de las siguientes opciones excluyentes:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400; color: #000000;\">Podr\u00e1 solicitar y retirar el saldo de los fondos de cesant\u00eda acumulados en su cuenta individual m\u00e1s los fondos que se acumularen en la misma cuenta por efecto de la aportaci\u00f3n del 2% personal y su rendimiento para configurar la parte variable del Seguro de Desempleo; o<\/span><\/li>\n<li><span style=\"color: #000000;\">Podr\u00e1 acogerse al Seguro de Desempleo y solicitar al final de su cobertura la entrega del saldo acumulado una vez efectuados los pagos correspondientes a dicho seguro en la forma prevista en esta ley<\/span><\/li>\n<\/ul>\n<p><b>\u00a0<\/b><\/p>\n<p><b>Duraci\u00f3n de la prestaci\u00f3n: <\/b><span style=\"font-weight: 400; color: #000000;\">M\u00e1ximo de cinco (5) meses por cada evento.<\/span><\/p>\n<p><b>\u00a0<\/b><\/p>\n<p><b>Del pago:<\/b><span style=\"font-weight: 400; color: #000000;\"> Una vez cumplidos los requisitos previstos en esta ley, los pagos correspondientes al seguro de desempleo se efectuar\u00e1n de forma mensual a partir del d\u00eda 91 de suscitado el
