MDT-2020-001 DEL INSTRUCTIVO PARA EL CUMPLIMIENTO DE OBLIGACIONES DE EMPLEADORES<\/b><\/p>\n<p><b>Art. 10.- Obligaciones en materia de seguridad, salud del trabajo y gesti\u00f3n de riesgos<\/b><b>.- <\/b><span style=\"font-weight: 400; color: #000000;\">El empleador deber\u00e1 efectuar el registro, aprobaci\u00f3n, notificaci\u00f3n y\/o reporte de obligaciones laborales en materia de seguridad y salud en el trabajo, respecto de los siguientes temas:<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">a)<\/span> <span style=\"font-weight: 400;\">Responsables en la Gesti\u00f3n en Seguridad y Salud en el Trabajo<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">b)<\/span> <span style=\"font-weight: 400;\">Reglamento de Higiene y Seguridad<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">c)<\/span> <span style=\"font-weight: 400;\">Organismos Paritarios<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">d)<\/span> <span style=\"font-weight: 400;\">Identificaci\u00f3n de peligros ; medici\u00f3n, evaluaci\u00f3n y control de riesgos laborales<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">e)<\/span> <span style=\"font-weight: 400;\">Planes de prevenci\u00f3n de riesgos laborales, salud en el trabajo, emergencia y contingencia<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">f)<\/span><span style=\"font-weight: 400;\"> \u00a0<\/span><span style=\"font-weight: 400;\">Gesti\u00f3n de vigilancia en la salud<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">g)<\/span> <span style=\"font-weight: 400;\">Programas de prevenci\u00f3n, promoci\u00f3n y capacitaci\u00f3n en materia de Seguridad y Salud en el Trabajo, y;<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">h)<\/span> <span style=\"font-weight: 400;\">Accidentes e incidentes de trabajo y enfermedades profesionales<\/span><\/span><\/p>\n<p><b>Art 13.- <\/b><b>Obligaciones del Registro de Reglamentos Internos<\/b><span style=\"font-weight: 400;\">.<span style=\"color: #000000;\"> Las empresas que cuenten con 1 a 10 trabajadores deber\u00e1n \u00fanicamente reportar en la plataforma inform\u00e1tica del Ministerio del Trabajo el plan de prevenci\u00f3n de riesgos laborales, de acuerdo al formato e instructivo establecido.\u00a0<\/span><\/span><\/p>\n<p><b>Art 16.<\/b><span style=\"font-weight: 400;\"> &#8211; <\/span><b>Multas por incumplimiento de las obligaciones en materia de seguridad, salud del trabajo y gesti\u00f3n integral de riesgos<\/b><span style=\"font-weight: 400;\">.- <span style=\"color: #000000;\">\u00a0En caso de incumplimiento de las obligaciones laborales en materia de seguridad, salud del trabajo y gesti\u00f3n integral de riesgos, notificar\u00e1n al empleador con una providencia preventiva de sanci\u00f3n para que en el t\u00e9rmino de quince (15) d\u00edas contados desde su notificaci\u00f3n a trav\u00e9s de las Inspector\u00edas del Trabajo ejerza el derecho a su defensa, vencido el cual, de no desvirtuar el incumplimiento, el Ministerio del Trabajo impondr\u00e1 al empleador una multa equivalente a doscientos d\u00f3lares de los Estados Unidos de Norteam\u00e9rica (USD 200), por cada trabajador; hasta un m\u00e1ximo de veinte salarios b\u00e1sicos unificados (20 SBU).<\/span><\/span><span style=\"color: #000000;\"><b>\u00a0<\/b><\/span><\/p>\n<p><em><span style=\"color: #7e9fbb;\"><b>Base legal<\/b><\/span><\/em><\/p>\n<p><em><span style=\"font-weight: 400;\">Acuerdo Ministerial Nro.
