{"id":27024,"date":"2020-11-30T12:19:28","date_gmt":"2020-11-30T17:19:28","guid":{"rendered":"https:\/\/acl.com.ec\/?p=27024"},"modified":"2020-11-30T12:19:28","modified_gmt":"2020-11-30T17:19:28","slug":"correcto-registro-de-las-novedades-de-los-trabajadores-bajo-relacion-de-dependencia","status":"publish","type":"post","link":"https:\/\/acl.com.ec\/en\/correcto-registro-de-las-novedades-de-los-trabajadores-bajo-relacion-de-dependencia\/","title":{"rendered":"CORRECTO REGISTRO DE LAS NOVEDADES DE LOS TRABAJADORES BAJO RELACI\u00d3N DE DEPENDENCIA"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text]<\/p>\n<div class=\"title-h1\" style=\"text-align: center;\"><span style=\"color: #7e9fbb;\">RECORDATORIO PARA EMPLEADORES:<\/span><\/div>\n<div class=\"title-h1\" style=\"text-align: center;\"><span style=\"color: #003048;\">CORRECTO REGISTRO DE LAS \u00a0NOVEDADES DE LOS TRABAJADORES BAJO RELACI\u00d3N DE DEPENDENCIA<\/span><\/div>\n<div><\/div>\n<p>[\/vc_column_text][vc_single_image image=\u00bb27028&#8243; img_size=\u00bbfull\u00bb alignment=\u00bbcenter\u00bb][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\">El art\u00edculo 73 de la Ley de Seguridad Social establece:<\/span><\/p>\n<p><span style=\"color: #000000;\"><em><strong><span style=\"color: #7e9fbb;\"> \u201c(\u2026) El empleador dar\u00e1 aviso al IESS de la modificaci\u00f3n del sueldo o salario, la enfermedad, la separaci\u00f3n del trabajador, u otra novedad relevante para la historia laboral del asegurado, dentro del t\u00e9rmino de tres (3) d\u00edas posteriores a la ocurrencia del hecho (\u2026)\u201d.<\/span><\/strong><\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\">El art\u00edculo 42 numeral 31 del C\u00f3digo de Trabajo se\u00f1ala como obligaciones del empleador: <\/span><\/p>\n<p><strong><em><span style=\"color: #7e9fbb;\">\u201cInscribir a los trabajadores en el Instituto Ecuatoriano de Seguridad Social, desde el primer d\u00eda de labores, dando aviso de entrada dentro de los primeros quince d\u00edas, y dar avisos de salida, de las modificaciones de sueldos y salarios, de los accidentes de trabajo y de las enfermedades profesionales, y cumplir con las dem\u00e1s obligaciones previstas en las leyes sobre seguridad social\u201d.\u00a0<\/span><\/em><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\">Los art\u00edculos 3 numeral 1; 32 y 34 de la Constituci\u00f3n de la Rep\u00fablica del Ecuador en concordancia con los art\u00edculos 1 y 17 de la Ley de Seguridad Social garantizan el derecho a la seguridad social de todas las personas, siendo deber y responsabilidad primordial del Estado velar por su cumplimiento; por tanto se recuerda que el uso inapropiado de la opci\u00f3n del sistema \u201cModificaci\u00f3n de n\u00famero d\u00edas\u201d del trabajador, implica afectaciones en el acceso a las prestaciones por parte de los afiliados, principalmente las del Seguro General de Salud Individual y Familiar.<\/span><br \/>\n<span style=\"color: #000000;\">Por lo tanto, para el registro de novedades a tiempo parcial de las modalidades contractuales expedidas por el Ministerio de Trabajo; y en cumplimiento a la Ley Org\u00e1nica de Apoyo Humanitario, para la reducci\u00f3n de jornada y contrato especial emergente de jornada parcial, se encuentran habilitadas en el sistema de historia laboral las siguientes relaciones de trabajo:<\/span><\/p>\n<p><span style=\"color: #7e9fbb;\"><strong>16-TRABAJADORES TIEMPO PARCIAL \u2013 CT\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong><\/span><br \/>\n<span style=\"color: #7e9fbb;\"><strong>111-TRABAJ PARCIAL DISCONT TURISTICO\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong><\/span><br \/>\n<span style=\"color: #7e9fbb;\"><strong>112-TRABAJ PARCIAL PERMANT TURISTICO\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong><\/span><br \/>\n<span style=\"color: #7e9fbb;\"><strong>113-TRABAJ PARCIAL DISCONT FLORICOLA\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong><\/span><br \/>\n<span style=\"color: #7e9fbb;\"><strong>114-TRABAJ PARCIAL PERMANT FLORICOLA<\/strong><\/span><br \/>\n<span style=\"color: #7e9fbb;\"><strong>115-TRABAJ PARCIAL DISCONT BANANERO<\/strong><\/span><br \/>\n<span style=\"color: #7e9fbb;\"><strong>116-TRABAJ PARCIAL DISCONT AGRICOLA<\/strong><\/span><br \/>\n<span style=\"color: #7e9fbb;\"><strong>117-TRABAJ PARCIAL PERMANT GANADERO<\/strong><\/span><br \/>\n<span style=\"color: #7e9fbb;\"><strong>120.- CTTO.
