MDT-2020-181<\/strong><\/span><\/div>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_single_image image=\u00bb26751&#8243; img_size=\u00bbfull\u00bb alignment=\u00bbcenter\u00bb][vc_column_text]<span style=\"color: #08253d;\"><strong>DIRECTRICES PARA LA APLICACI\u00d3N DEL TELETRABAJO EN EL C\u00d3DIGO DEL TRABAJO, CONFORME LO ESTABLECIDO EN LA LEY ORG\u00c1NICA DE APOYO HUMANITARIO PARA COMBATIR LA CRISIS SANITARIA DERIVADA DEL COVID-19<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #08253d;\">Seg\u00fan Acuerdo Ministerial Nro. MDT-2020-181 se establecen las directrices para regular la aplicaci\u00f3n de la modalidad del teletrabajo.<\/span><\/p>\n<p><span style=\"color: #08253d;\"><strong>El teletrabajo<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"color: #08253d;\">No afecta ni altera las condiciones de la relaci\u00f3n laboral.<\/span><\/li>\n<li><span style=\"color: #08253d;\">No constituye por s\u00ed misma causal de terminaci\u00f3n de la relaci\u00f3n de trabajo.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #08253d;\">Esta modalidad podr\u00e1 aplicarse en jornada completa o parcial, respetando:<\/span><\/p>\n<ul>\n<li><span style=\"color: #08253d;\">Los l\u00edmites de jornada m\u00e1xima.<\/span><\/li>\n<li><span style=\"color: #08253d;\">D\u00edas de descanso.<\/span><\/li>\n<li><span style=\"color: #08253d;\">Pago de horas extraordinarias y suplementarias<\/span><\/li>\n<\/ul>\n<p>[\/vc_column_text][gem_icon icon_material=\u00bbf11a\u00bb size=\u00bblarge\u00bb][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<span style=\"color: #08253d;\"><strong>Herramientas para el teletrabajo<\/strong><\/span><\/p>\n<p><span style=\"color: #08253d;\">El empleador deber\u00e1:<\/span><\/p>\n<ul>\n<li><span style=\"color: #08253d;\">Proveer los equipos, lineamientos e insumos necesarios para su desarrollo.<\/span><\/li>\n<li><span style=\"color: #08253d;\">Notificar al trabajador con las directrices para supervisar y monitorear la ejecuci\u00f3n de sus actividades; garantizando la salud y seguridad del trabajador.<\/span><\/li>\n<\/ul>\n<p>[\/vc_column_text][gem_icon icon_material=\u00bbf283&#8243; size=\u00bblarge\u00bb][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<span style=\"color: #08253d;\">El trabajador tendr\u00e1 derecho a:<\/span><\/p>\n<ul>\n<li><span style=\"color: #08253d;\">Desconexi\u00f3n al menos 12 horas continuas en un per\u00edodo de 24 horas.<\/span><\/li>\n<li><span style=\"color: #08253d;\">Mantener el tiempo de descanso que manten\u00eda en la modalidad presencial.<\/span><\/li>\n<li><span style=\"color: #08253d;\">Tiempo de almuerzo.<\/span><\/li>\n<li><span style=\"color: #08253d;\">En los casos de jornada parcial se establecer\u00e1 un descanso al menos cada cuatro horas de teletrabajo continuo.<\/span><\/li>\n<\/ul>\n<p>[\/vc_column_text][gem_icon icon_material=\u00bbf30f\u00bb size=\u00bblarge\u00bb][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<span style=\"color: #08253d;\"><strong>Del registro y notificaci\u00f3n<\/strong><\/span><\/p>\n<p><span style=\"color: #08253d;\">Previo a aplicar esta modalidad, el empleador debe notificar por correo o f\u00edsicamente al trabajador esta decisi\u00f3n, y hasta 15 d\u00edas posteriores realizar el registro en el SUT<\/span><\/p>\n<p><span style=\"color: #08253d;\"><strong>Imposibilidad del teletrabajo<\/strong><\/span><\/p>\n<p><span style=\"color: #08253d;\">El empleador no podr\u00e1 hacer uso de esta modalidad cuando:<\/span><\/p>\n<ul>\n<li><span style=\"color: #08253d;\">La naturaleza de las labores del trabajador imposibilite la adopci\u00f3n del teletrabajo.<\/span><\/li>\n<li><span style=\"color: #08253d;\">La naturaleza de la labor ejecutada por el trabajador permita la adopci\u00f3n del teletrabajo pero el trabajador se ve imposibilitado de ejecutarla.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #08253d;\"><strong>De la reversibilidad<\/strong><\/span><\/p>\n<p><span style=\"color: #08253d;\">El trabajador volver\u00e1 a la modalidad presencial por pedido del empleador, excepto si:<\/span><\/p>\n<ol>\n<li><span style=\"color: #08253d;\">El contrato de trabajo se hubiese modificado permanentemente por acuerdo entre las partes hacia la modalidad de teletrabajo; y,<\/span><\/li>\n<li><span style=\"color: #08253d;\">Por disposici\u00f3n de autoridad competente no fuera posible el trabajo presencial.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #08253d;\"><strong>Remuneraci\u00f3n<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"color: #08253d;\">No podr\u00e1 ser menor al salario b\u00e1sico o los salarios sectoriales determinados para jornada completa ordinaria o su proporcional para jornada parcial.<\/span><\/li>\n<li><span style=\"color: #08253d;\">El pago podr\u00e1 ser diario, semanal, quincenal o mensual previo acuerdo de las partes.<\/span><\/li>\n<\/ul>\n<p>[\/vc_column_text][gem_icon icon_material=\u00bbf272&#8243;
